Rear spoiler fog or brake lights?

Got a Suzuki Ignis rear spoiler to modify for Skylark (as per HJ did previously) but going to keep the integrated brake/fog light that’s on it. As far as I know it’s a fog light on the Suzuki but is there any regulation to stop me using it as a high line brake light instead or was it a brake light anyway on the Suzuki originally?

Think I have answered my own question:
It’s a high line brake light as these are the fog lights
